Is mediation confidential?
Yes. Participants sign a confidentiality agreement. What's said can't be used in later proceedings, except where the law requires disclosure, such as a serious risk to safety.
Is mediation legally binding?
Workplace agreements are usually binding in good faith rather than as contracts. Employment and commercial settlements are formalised into binding deeds by lawyers.
What's the difference between mediation and conciliation?
In mediation the mediator manages the process but doesn't advise on outcomes. In conciliation the conciliator may suggest terms or give views on the merits.
Do I need a lawyer?
Not for most workplace mediations. For employment claims or commercial disputes, legal advice before and during mediation is often helpful.
What if the other person won't participate?
We can contact them neutrally to explain the process. If they still decline, conflict coaching or a facilitated conversation may help.
How much does mediation cost?
Workplace mediation starts at $3,950 + GST fixed fee. See our pricing page for all packages and retainers.
Who pays?
Usually the employer for workplace matters. Commercial mediation fees are commonly split between the parties.
Is there a free consultation?
Yes. A 20-minute confidential call with a mediator, with no obligation.
How quickly can you start?
Usually within 5 business days, or 3 days for retainer clients. Urgent matters can often be seen within 48 hours.
How long does mediation take?
Most workplace mediations are one day, plus pre-sessions in the week before. Complex matters may need two days.
Do you offer online mediation?
Yes, via a secure Australian-hosted video platform with private breakout rooms.
Are your mediators accredited?
Yes. All are accredited under the Australian Mediator and Dispute Resolution Accreditation Standards (AMDRAS).
Can the same person investigate and mediate?
No. We always use separate practitioners so neutrality is never in question.
How do you stay neutral if the employer pays?
Our agreement is with the process, not either party. Fees and roles are disclosed to everyone, and either party can raise concerns about neutrality at any time.
