For employees & managers
Been invited to mediation? Here's what you need to know.
It's normal to feel nervous. Mediation isn't a disciplinary process, and nobody will decide who's right. It's a chance to be heard and have a say in what happens next.
Your rights
What mediation is, and isn't
Mediation is
- Voluntary. You can pause or stop at any time
- Confidential. What you say stays in the room
- A chance to explain your side fully, in private first
- A process where you help decide the outcome
- Supported. You can bring a support person
Mediation is not
- A disciplinary meeting or investigation
- A place where anyone decides who was right
- An obligation to agree to anything
- Reported back to HR word-for-word
- A replacement for legal advice if you need it
Preparation
Are you ready for your mediation?
Tick off what you've done. Most people feel much calmer after the first few.
Questions
What participants ask us
Will this go on my record?
No. Mediation isn't disciplinary. Only the agreement is shared, and only with your consent.
What if I don't want to be in the same room?
Tell your mediator. We can use shuttle mediation, where we move between rooms, or online sessions.
Can I bring my union rep?
Yes, as a support person. They can advise you during breaks.
What if I feel pressured to agree?
You never have to agree to anything. Your mediator will check agreements with you privately first.
Who pays for this?
Usually your employer. That doesn't change our neutrality. We work for the process, not either side.
No questions match that search. Try another word, or ask us directly.
Next step
Have a question before your mediation?
Call us confidentially. We'll explain the process and answer any concerns. You don't need to give your name.
